La ausencia de un secretario o instructor imparcial, tal como requiere el convenio colectivo aplicable, en el expediente contradictorio tramitado para imponer una sanci\u00f3n a un representante de los trabajadores por la comisi\u00f3n de una falta muy grave, constituye el incumplimiento de una garant\u00eda esencial del procedimiento. Este incumplimiento conlleva que el despido disciplinario sea calificado como improcedente o la sanci\u00f3n como nula.<\/p>\n<p style=\"text-align: justify;\">El Tribunal interpreta el alcance del art\u00edculo 56.4 b) del Convenio Colectivo Estatal de Conservas Vegetales, que regulaba el procedimiento sancionador, y que exig\u00eda el nombramiento de un instructor y secretario imparciales, quienes no fueron designados en este caso. Aunque el convenio no establece una consecuencia espec\u00edfica para la falta de dicha designaci\u00f3n, se argumenta que las formalidades estipuladas en los convenios colectivos para la tramitaci\u00f3n del expediente contradictorio constituyen una garant\u00eda adicional en beneficio de los representantes de los trabajadores. Su prop\u00f3sito es asegurar una adecuada defensa preventiva, dada la condici\u00f3n especial del trabajador como representante.
