La persona trabajadora afectada denunci\u00f3 el incidente por correo electr\u00f3nico a recursos humanos el 12 de agosto de 2022. La empresa llev\u00f3 a cabo una investigaci\u00f3n interna y advirti\u00f3 a Augusto para que no repitiera comentarios similares.El trabajador demandante estuvo de baja por enfermedad com\u00fan, diagnosticada como ansiedad, durante 3 meses. La persona trabajadora reclama 225.018 euros por da\u00f1os morales (empresa y trabajador que hizo el comentario). El Juzgado de primera instancia desestim\u00f3 la demanda de la persona trabajadora, imponiendo una multa por temeridad. Aunque el TSJ reconoce que el comentario de Augusto fue desafortunado, lo considera como un incidente aislado y correctamente abordado por la empresa. Adem\u00e1s, no encontr\u00f3 evidencia de que el comentario haya llevado a una postergaci\u00f3n profesional del trabajador afectado.<\/p>\n<p>El TSJ argumenta que el comentario, aunque hizo referencia a la apariencia externa del demandante, no cre\u00f3 un ambiente intimidatorio, hostil, degradante, humillante u ofensivo. Tambi\u00e9n se\u00f1ala que el comentario se realiz\u00f3 en un contexto de confianza entre compa\u00f1eros de trabajo y que podr\u00eda haber sido interpretado de varias maneras, no necesariamente como un ataque personal.
