La Sala de lo Social ha se\u00f1alado que penalizar el cobro del bonus por ausencias vinculadas con una situaci\u00f3n de salud desfavorable para el trabajador, ajena en todo punto a su voluntad, es contraria a la Ley 15\/2022, de 12 de julio, integral para la igualdad de trato y la no discriminaci\u00f3n, y por tanto, considera la nulidad de este tipo de cl\u00e1usulas. El presente conflicto afecta a los trabajadores de una empresa que prestan servicios en los departamentos de <em>front office<\/em>, tramitaci\u00f3n y reclamaciones, a los que resulta de aplicaci\u00f3n los planes de incentivos vigentes desde abril a diciembre de 2023. La mercantil les comunic\u00f3 el cambio de modelo de bonificaciones. Concretamente, el nuevo modelo estaba compuesto por 15 punto, de los cuales 10 correspond\u00edan a objetivos operativos y 5 al absentismo. En este \u00faltimo se indicaban los tipos de ausencias como el absentismo no recuperable que se refer\u00eda a estos tres casos: incapacidad temporal, indisposici\u00f3n puntual y reposo m\u00e9dico, as\u00ed como su incidencia en la retribuci\u00f3n del incentivo, que se podr\u00eda suprimir o reducir el cobro del bonus. En este sentido, la Sala indica que &#8220;si comparamos la situaci\u00f3n en que se encuentran dos trabajadores de la empresa que perciben incentivos por ventas en la gesti\u00f3n telef\u00f3nica, resulta evidente que, a aquellos trabajadores que, por encontrarse en IT, hubieran superado los \u00edndices de absentismo exigidos en el plan, se les estar\u00eda dispensando un trato desigual y menos favorable que a los trabajadores que no hubieran causado periodos de IT en el tramo temporal de referencia&#8221;. Asimismo, la Audiencia Nacional a\u00f1ade que es leg\u00edtimo que la empresa procure disminuir el absentismo a trav\u00e9s de un plan de incentivos que promueva medidas para su reducci\u00f3n, lo que no es aceptable es que se incluyan criterios relacionados con la salud de los trabajadores, penalizando situaciones de incapacidad temporal que constituyen ausencias &#8220;plenamente justificadas&#8221;.
