Estos solo se indemnizar\u00e1n si la trabajadora despedida prueba que la extinci\u00f3n estuvo motivado por su condici\u00f3n de embarazada. Seg\u00fan establece el Alto Tribunal, se ha probado que la compa\u00f1\u00eda, que reconoci\u00f3 la improcedencia del despido, \u201cse enter\u00f3 del embarazo de la trabajadora en el momento de la entrega de la carta de despido y que su despido coincidi\u00f3 con el de otros cinco trabajadores\u201d, y por tanto, considera que no hay un \u201cm\u00f3vil discriminatorio\u201d que d\u00e9 lugar a una indemnizaci\u00f3n por da\u00f1os morales. La mujer fue despedida en octubre de 2021 por \u201cdisminuci\u00f3n continuada y voluntaria del rendimiento normal en su puesto de trabajo\u201d y, seg\u00fan declar\u00f3 probado la sentencia de instancia, la trabajadora supo que estaba embarazada \u201cdespu\u00e9s de la entrega de la carta de despido\u201d. Por ello, se trata de un despido nulo por imperativo legal que se produce por el hecho de que la trabajadora est\u00e9 embarazada.
