Esta decisi\u00f3n afecta a un caso en el que una empresa de atenci\u00f3n telef\u00f3nica retir\u00f3 un complemento diario de 5,59 euros para 41 personas trabajadoras del turno nocturno que pasaron a teletrabajar en enero de 2021. Los sindicatos UGT, CSIF y USO argumentaron que este complemento se deb\u00eda mantener, pero el Tribunal Supremo considera que el acuerdo de teletrabajo no modifica la naturaleza no salarial del complemento y que su pago fue por un per\u00edodo breve, por lo que no se puede considerar como una condici\u00f3n m\u00e1s beneficiosa. Seg\u00fan el Alto Tribunal, la compa\u00f1\u00eda solo acord\u00f3 el teletrabajo con las personas trabajadoras del turno nocturno sin cambiar sus condiciones laborales anteriores, que estaban en l\u00ednea con el convenio colectivo de aplicaci\u00f3n. Por lo tanto, no se puede asumir que la empresa ten\u00eda la intenci\u00f3n clara de seguir pagando el plus transporte durante el teletrabajo, especialmente porque solo se abon\u00f3 durante nueve meses y luego fue retirado.
