Esta decisi\u00f3n legal es significativa y tendr\u00e1 repercusiones jur\u00eddicas importantes. Por un lado, requerir\u00e1 probablemente una revisi\u00f3n del art\u00edculo 49.1.e) del Estatuto de los Trabajadores, y por otro, obligar\u00e1 a las empresas a reconsiderar sus pol\u00edticas de prevenci\u00f3n y realizar ajustes razonables antes de terminar un contrato de trabajo debido a la incapacidad total permanente del empleado.<\/p>\n<p>En esencia, el caso involucra un conflicto entre un trabajador que tiene una incapacidad permanente total y por tanto impedido de realizar las funciones habituales de su puesto de trabajo. En este contexto, la empresa que decide extinguir su contrato bajo el amparo del art\u00edculo 49.1.e) del ET. Este art\u00edculo permite el despido en casos de muerte, gran invalidez o incapacidad permanente total o absoluta del trabajador, sin necesidad de realizar ajustes previos o encontrarle otro puesto, a menos que se indique de tal manera en el convenio colectivo de aplicaci\u00f3n o en el contrato de trabajo.<\/p>\n<p>En este sentido, El Tribunal Superior de Justicia de Baleares cuestion\u00f3 dos aspectos:<\/p>\n<ol>\n<li>Si la legislaci\u00f3n espa\u00f1ola que permite la extinci\u00f3n autom\u00e1tica del contrato debido a la incapacidad del trabajador contraviene el art\u00edculo 5 de la Directiva 2000\/78 de la Uni\u00f3n Europea, que establece la obligaci\u00f3n de realizar &#8220;ajustes razonables&#8221; para mantener el empleo de personas con discapacidad.<\/li>\n<li>Si esta extinci\u00f3n autom\u00e1tica, sin considerar ajustes razonables, constituye discriminaci\u00f3n directa, a pesar de que el Estatuto de los Trabajadores lo permita.<\/li>\n<\/ol>\n<p>El TJUE interpret\u00f3 la Directiva y defini\u00f3 claramente la &#8220;discriminaci\u00f3n por motivos de discapacidad&#8221;. Concluy\u00f3 que la negaci\u00f3n de ajustes razonables constituye discriminaci\u00f3n, y seg\u00fan la Directiva, un trabajador incapacitado debe ser reubicado siempre que sea razonable para el empleador. Adem\u00e1s, indic\u00f3 que una normativa nacional que obliga a un trabajador a perder su empleo para acceder a una prestaci\u00f3n de seguridad social socava el prop\u00f3sito de la Directiva.<\/p>\n<p>En resumen, la normativa espa\u00f1ola que permite el despido autom\u00e1tico de un trabajador discapacitado sin considerar ajustes razonables se considera contraria a la Directiva de la UE y constituye discriminaci\u00f3n.
