El trabajador aleg\u00f3 que no tuvo la oportunidad de dar sus argumentos sobre las supuestas infracciones imputadas a \u00e9ste en el expediente disciplinario por lo que invoc\u00f3 el art\u00edculo 7 del Convenio 158 de la OIT que establece que debe abrirse un expediente contradictorio cuando los trabajadores son despedidos por motivos disciplinarios, d\u00e1ndoles la oportunidad de defenderse. El Tribunal da la raz\u00f3n al trabajador y declara el despido improcedente.<\/p>\n<p>Observaciones: La normativa laboral (Estatuto de los Trabajadores) espa\u00f1ola no exige la apertura de un expediente disciplinario contradictorio y este requisito lo establecen los convenios colectivos de aplicaci\u00f3n, en todo caso. Esta sentencia aplica directamente una disposici\u00f3n internacional, ya que Espa\u00f1a ha ratificado el Convenio Internacional, independientemente de que el Convenio Colectivo aplicable lo exija o no.<\/p>\n<p>Implicaciones: Se trata de la primera sentencia en Espa\u00f1a que declara la aplicaci\u00f3n del Art. 7 Convenio 158 de la OIT por lo que a\u00fan no es jurisprudencia que establezca una doctrina definitiva.
