width=&#8221;1\/1&#8243; uncode_shortcode_id=&#8221;143397&#8243;][vc_column_text uncode_shortcode_id=&#8221;513031&#8243;]Caso: El art\u00edculo 5.2. del Real Decreto 901\/2020 dice que los Planes de Igualdad deben negociarse entre la empresa y los representantes de los trabajadores. En ausencia de representantes de los trabajadores, la Empresa debe llamar a los sindicatos m\u00e1s representativos que negociaron el convenio colectivo aplicable en la empresa para constituir la comisi\u00f3n negociadora del Plan de Igualdad. En este caso, la Empresa llam\u00f3 a los sindicatos, pero no recibi\u00f3 respuesta en el plazo legal de 10 d\u00edas que exige la norma. En consecuencia, la Empresa decidi\u00f3 crear un comit\u00e9 <em>ad hoc<\/em> de Trabajadores y negociar el Plan de Igualdad sin la presencia de los sindicatos para no retrasar la exigencia normativa de contar con un Plan de Igualdad. El Tribunal valida la decisi\u00f3n adoptada por esta empresa y declara ajustado a derecho el Plan de Igualdad.<\/p>\n<p>Observaciones: Este ha sido un tema muy debatido dada la incertidumbre creada por el Real Decreto (buscar norma, creo que es 190\/2020-21) que obliga a las empresas a depender de la respuesta\/no respuesta de los sindicatos para sentarse con ellos a negociar sus Planes de Igualdad.
