La empresa le ofreci\u00f3 un puesto vacante a tiempo parcial (alegando que era la \u00fanica vacante disponible), la cual el Empleado acept\u00f3 reserv\u00e1ndose el derecho a ser contratado a tiempo completo cuando quedar\u00e1 libre una vacante, con la finalidad de cumplir con la disposici\u00f3n legal del Estatuto de los Trabajadores \u201c<em>El trabajador en excedencia voluntaria conserva solo un derecho preferente al reingreso en las vacantes de igual o similar categor\u00eda a la suya que hubiera o se produjeran en la empresa.<\/em>\u201d.<\/p>\n<p>Unos meses m\u00e1s tarde, la empresa contrata a otro empleado a tiempo completo para un puesto equivalente al del Empleado que regres\u00f3 de la excedencia, por lo que \u00e9ste alega que se le deber\u00eda haber ofrecido el puesto a tiempo completo con car\u00e1cter preferente. El Juzgado de lo Social y el TSJ dan la raz\u00f3n al Empleado. Asimismo, la sentencia fue confirmada por el Tribunal Supremo que declar\u00f3 el derecho del Empleado a la vacante a tiempo completo puesto que, eran las condiciones que ven\u00eda disfrutando antes de la excedencia y, que expresamente hab\u00eda solicitado cuando reingres\u00f3 en la Empresa tras la excedencia.
