text_color_type=&#8221;uncode-palette&#8221;]Novedades[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;365003&#8243;]Caso: En el contexto de una interinidad la Empresa desplaz\u00f3 temporalmente a un trabajador a otro centro y cubri\u00f3 el puesto con un contrato de sustituci\u00f3n. El demandante consider\u00f3 que esta situaci\u00f3n (con varias pr\u00f3rrogas desde 2016) significaba que el supuesto contrato &#8220;interino&#8221; era indefinido y no de duraci\u00f3n determinada. El Juzgado de lo Social y el Tribunal Superior de Justicia discreparon y es por ello por lo que la reclamante interpuso recurso ante el Tribunal Supremo que declar\u00f3 el contrato indefinido.<\/p>\n<p>Observaciones: El Tribunal Supremo aclara que ese contrato de interinidad debe cumplir los siguientes requisitos:<\/p>\n<ol>\n<li>Existencia de una reserva de puesto de trabajo, independientemente de que el contrato a cubrir est\u00e9 suspendido o no.<\/li>\n<li>La sustituci\u00f3n debe ser realmente de duraci\u00f3n determinada, es decir, debe tratarse de un caso puntual de corta duraci\u00f3n que requiera efectivamente la cobertura de la persona sustituida (no un traslado permanente para ser sustituido).<\/li>\n<li>Deben existir razones organizativas o productivas que justifiquen la cobertura temporal del puesto de trabajo.<\/li>\n<\/ol>\n<p>La fundamentaci\u00f3n jur\u00eddica para declarar el contrato indefinido se bas\u00f3 en que no era una situaci\u00f3n realmente temporal, ya que superaba el umbral legal de desplazamiento temporal (&gt;12 meses en un periodo de 3 a\u00f1os) y, por ende, pod\u00eda calificarse como traslado (y no como adscripci\u00f3n temporal).
