text_color_type=&#8221;uncode-palette&#8221;]Novedades[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;172076&#8243;]El Tribunal Superior de Justicia de Catalu\u00f1a se pronuncia sobre la concesi\u00f3n de una indemnizaci\u00f3n adicional a la tasada para la declaraci\u00f3n del despido procedente, estimando la declaraci\u00f3n de concesi\u00f3n de dicha indemnizaci\u00f3n.<\/p>\n<p>La sentencia analiza la declaraci\u00f3n de nulidad o improcedencia de un despido objetivo que tiene como causa la situaci\u00f3n generada tras la pandemia del Covid-19. Una vez el tribunal declara la improcedencia del despido, estudian la petici\u00f3n de la empleada en relaci\u00f3n con la concesi\u00f3n de una indemnizaci\u00f3n adicional a la legalmente tasada.<\/p>\n<p>En este sentido, el tribunal recuerda que, en el \u00e1mbito laboral, existen unas indemnizaciones tasadas, cuyo calculo se realiza conforme a la legislaci\u00f3n, en la que se prescinde para la determinaci\u00f3n de la cuant\u00eda de par\u00e1metros como el da\u00f1o emergente, el lucro cesante o los da\u00f1os morales causados. No obstante, existe una excepci\u00f3n a esta regla general, cuando la decisi\u00f3n extintiva ha sido adoptada por motivos discriminatorios o con vulneraci\u00f3n de derechos fundamentales.<\/p>\n<p>Asimismo, menciona el tribunal que existen numerosos pronunciamientos que admiten la posibilidad de reconocer a los empleados una indemnizaci\u00f3n superior a la establecida legalmente, bas\u00e1ndose en el Convenio 158 de la OIT y la Carta Social Europea, que consideran dicha indemnizaci\u00f3n complementaria cuando la correspondiente al despido improcedente sea exigua y no tenga un efecto disuasorio para la empresa, ni compense suficientemente a los empleados, concurriendo asimismo una clara y evidente ilegalidad, fraude de ley o abuso de derecho en la decisi\u00f3n empresarial extintiva.<\/p>\n<p>En el presente caso, la empleada ten\u00eda una antig\u00fcedad de 5 meses en la compa\u00f1\u00eda y fue despedida 2 d\u00edas antes de que se llevara a cabo un ERTE en la empresa, por ello, reclama la indemnizaci\u00f3n adicional teniendo en cuenta los da\u00f1os y perjuicios sufridos, y el lucro cesante, teniendo en cuenta lo que ha dejado de percibir por prestaci\u00f3n de desempleo y por la p\u00e9rdida de la posibilidad de ser incluida en dicho ERTE.<\/p>\n<p>Por todo ello, y citando pronunciamientos que han admitido dicha posibilidad, el tribunal considera ajustado a derecho recibir una indemnizaci\u00f3n complementaria en estos casos, determinando que es esencial reflejar en el petitum de la demanda por despido, los da\u00f1os y perjuicios que necesitan compensaci\u00f3n y la prueba contradictoria de dicha cuant\u00eda.<\/p>\n<p>Por \u00faltimo, valoran los da\u00f1os y perjuicios, adem\u00e1s del lucro cesante alegado por la empleada, y teniendo en cuenta la escasa cuant\u00eda de la indemnizaci\u00f3n legal, debido a la duraci\u00f3n de la antig\u00fcedad, y el perjuicio que supuso ser despida 2 d\u00edas antes del inicio del ERTE, se declara ajustado a derecho la solicitud de indemnizaci\u00f3n complementaria y, se condena a la empresa al abono de la cantidad de 3.493,3 euros estimando parcialmente la demanda de la empleada.[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row row_height_percent=&#8221;0&#8243; override_padding=&#8221;yes&#8221; h_padding=&#8221;2&#8243; top_padding=&#8221;2&#8243; bottom_padding=&#8221;0&#8243; overlay_alpha=&#8221;100&#8243; equal_height=&#8221;yes&#8221; gutter_size=&#8221;3&#8243; column_width_percent=&#8221;100&#8243; shift_y=&#8221;0&#8243; z_index=&#8221;0&#8243; row_height_use_pixel=&#8221;&#8221; uncode_shortcode_id=&#8221;167824&#8243;][vc_column column_width_percent=&#8221;100&#8243; gutter_size=&#8221;3&#8243; overlay_alpha=&#8221;50&#8243; shift_x=&#8221;0&#8243; shift_y=&#8221;0&#8243; shift_y_down=&#8221;0&#8243; [&hellip;]<\/p>\n","protected":false},"author":7,"featured_media":118996,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false,"rank_math_lock_modified_date":false,"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[88],"tags":[],"class_list":["post-118791","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-novedades-doctrina"],"_links":{"self":[{"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/posts\/118791","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/users\/7"}],"replies":[{"embeddable":true,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=118791"}],"version-history":[{"count":3,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/posts\/118791\/revisions"}],"predecessor-version":[{"id":119069,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/posts\/118791\/revisions\/119069"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=\/wp\/v2\/media\/118996"}],"wp:attachment":[{"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=118791"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=118791"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.practicalaboral.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=118791"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
