text_color_type=&#8221;uncode-palette&#8221;]Novedades[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;222308&#8243;]La sentencia resuelve el caso de un despido a un trabajador, que realizaba su jornada en la modalidad de teletrabajo, por realizar tareas dom\u00e9sticas o de contenido no profesional durante su horario de trabajo.<br \/>\nEl Juzgado de lo Social declar\u00f3 el despido como improcedente, declaraci\u00f3n que confirma el Tribunal Superior de Justicia en el presente pronunciamiento por los siguientes motivos:<br \/>\n&#8211; El trabajador con puesto de \u201ccomercial\u201d aunque tiene un horario determinado de 09:30 a 17:30 de lunes a viernes, es capaz de probar que dicho horario es flexible debido al contenido de la relaci\u00f3n laboral, as\u00ed como que ha prestado servicios tambi\u00e9n fuera de su jornada u horario habitual, incluso en sus vacaciones.<\/p>\n<p>&#8211; Asimismo, consta en hechos probados que el trabajador ha cumplido el 100% de sus objetivos individuales para con la empresa.<\/p>\n<p>&#8211; La empresa, que contrata un detective para confirmar que el trabajador llevaba a cabo tareas dom\u00e9sticas durante su jornada, y aunque el detective confirma que efectivamente realizaba tareas tales como: llevar a su hija al colegio, tomar algo en una cafeter\u00eda con terceras personas o jugar al p\u00e1del, tambi\u00e9n consta en el informe del detective que el empleado en algunas de estas ocasiones en las que estaba fuera de su domicilio tambi\u00e9n trabaja con el ordenador desde la parte posterior de su veh\u00edculo.<br \/>\nPor todo ello, tanto en la sentencia de instancia como en la presente, se determina que, aunque el trabajador durante su jornada ha llevado a cabo tareas no profesionales, s\u00ed se demuestra la implicaci\u00f3n en su trabajo, ya que, presta servicios fuera de su jornada habitual, incluso en vacaciones, habi\u00e9ndose demostrado a su vez que ha cumplido con los objetivos, no habiendo demostrado la empresa lo contrario en ning\u00fan caso.<br \/>\nPor \u00faltimo, considera muy relevante el tribunal en este caso que se ha demostrado la autonom\u00eda en la forma de trabajo y organizaci\u00f3n que caracterizaba la relaci\u00f3n laboral con la empleadora.[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row row_height_percent=&#8221;0&#8243;
