text_color_type=&#8221;uncode-palette&#8221;]Novedades[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;196826&#8243;]<\/p>\n<p align=\"justify\">El Tribunal Superior de Justicia de Madrid analiza el caso de un trabajador en r\u00e9gimen de trabajo a distancia despedido disciplinariamente por parte de la empresa, alegando la transgresi\u00f3n de la buena fe contractual ya que, realizaba tareas personales durante su horario laboral, falseando as\u00ed el registro de jornada.<\/p>\n<p align=\"justify\">Los hechos probados en la sentencia determinan que el empleado en cuesti\u00f3n durante su jornada realizaba gestiones personales tales como:<\/p>\n<ul>\n<li>\n<p align=\"justify\">Acompa\u00f1ar a su pareja al m\u00e9dico;<\/p>\n<\/li>\n<li>\n<p align=\"justify\">Acudir a la peluquer\u00eda;<\/p>\n<\/li>\n<li>\n<p align=\"justify\">Lavar su veh\u00edculo;<\/p>\n<\/li>\n<li>\n<p align=\"justify\">Trabajar desde Zaragoza sin notificar a la empresa del traslado;<\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\">En este sentido, el <u>empleado no reporto ninguna de estas situaciones\/ausencias, sino que llevo a cabo el registro de la jornada de trabajo como si hubiese trabajado con normalidad durante toda la jornada<\/u>.<\/p>\n<p align=\"justify\">La empresa fundament\u00f3 el despido disciplinario en las ausencias o abandono del puesto de trabajo, as\u00ed como la no realizaci\u00f3n de las tareas encomendadas y, por \u00faltimo, falsear la informaci\u00f3n referente a su actividad laboral.
