En este sentido, hoy d\u00eda 5 de diciembre se ha procedido a su publicaci\u00f3n en el Bolet\u00edn Oficial del Estado, que os adjuntamos por si fuera de vuestro inter\u00e9s.<\/p>\n<p>[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/1&#8243;][vc_row_inner][vc_column_inner column_width_percent=&#8221;100&#8243; gutter_size=&#8221;3&#8243; font_family=&#8221;font-339240&#8243; overlay_alpha=&#8221;50&#8243; shift_x=&#8221;0&#8243; shift_y=&#8221;0&#8243; shift_y_down=&#8221;0&#8243; z_index=&#8221;0&#8243; medium_width=&#8221;0&#8243; mobile_width=&#8221;0&#8243; css_animation=&#8221;bottom-t-top&#8221; width=&#8221;1\/1&#8243; uncode_shortcode_id=&#8221;143397&#8243;][vc_custom_heading text_color=&#8221;accent&#8221; heading_semantic=&#8221;h3&#8243; text_size=&#8221;h3&#8243; uncode_shortcode_id=&#8221;689615&#8243; text_color_type=&#8221;uncode-palette&#8221;]Novedades[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;640133&#8243;]La entrada en vigor del Real Decreto ser\u00e1 el d\u00eda 1 de abril de 2023, y las principales novedades que implica son las siguientes:<\/p>\n<ul>\n<li>En primer lugar, los m\u00e9dicos de atenci\u00f3n primaria cuando emitan la baja de los empleados no entregaran dos copias como ven\u00edan haciendo hasta ahora para que el trabajador pueda facilitar la segunda copia a la compa\u00f1\u00eda, sino que se elimina la segunda copia y con ella la obligaci\u00f3n del empleado de comunicar su baja a la compa\u00f1\u00eda.<\/li>\n<li>En cambio, se realizar\u00e1 una gesti\u00f3n telem\u00e1tica y ser\u00e1n los m\u00e9dicos, la SS, las mutuas y las empresas, los responsables de intercambiarse los documentos necesarios para gestionar el alta o baja m\u00e9dica, sin intervenci\u00f3n del trabajador en ning\u00fan caso.<\/li>\n<li>En el caso de bajas menores a cinco d\u00edas se emitir\u00e1n al mismo tiempo los partes de baja y de alta m\u00e9dica, como hasta el momento. Si el empleado no se ha recuperado, podr\u00e1 pedir una revisi\u00f3n antes de que sea efectiva su alta m\u00e9dica.<\/li>\n<li>Las bajas m\u00e9dicas de duraci\u00f3n superior a cinco d\u00edas incluir\u00e1n la fecha de revisi\u00f3n m\u00e9dica prevista (igualmente como hasta el momento). Los plazos m\u00e1ximos en que se tienen que hacer esas revisiones en caso de confirmaci\u00f3n de baja var\u00edan en funci\u00f3n de la duraci\u00f3n de la baja m\u00e9dica. Asimismo, las revisiones de confirmaci\u00f3n de baja o alta m\u00e9dica se podr\u00e1n avanzar a los plazos previstos cuando la empresa o la mutua lo consideren necesario, en funci\u00f3n de la evoluci\u00f3n del paciente.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][vc_row_inner][vc_column_inner column_width_percent=&#8221;100&#8243; gutter_size=&#8221;3&#8243; font_family=&#8221;font-339240&#8243; overlay_alpha=&#8221;50&#8243; shift_x=&#8221;0&#8243; shift_y=&#8221;0&#8243; shift_y_down=&#8221;0&#8243; z_index=&#8221;0&#8243; medium_width=&#8221;0&#8243; mobile_width=&#8221;0&#8243; css_animation=&#8221;bottom-t-top&#8221; width=&#8221;1\/1&#8243; uncode_shortcode_id=&#8221;143397&#8243;][vc_custom_heading text_color=&#8221;accent&#8221; heading_semantic=&#8221;h3&#8243; text_size=&#8221;h3&#8243; uncode_shortcode_id=&#8221;136739&#8243; text_color_type=&#8221;uncode-palette&#8221;]Gesti\u00f3n[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;989657&#8243;]El proceso de gesti\u00f3n se llevar\u00e1 a cabo de la siguiente manera:<\/p>\n<ul>\n<li>El m\u00e9dico o la mutua enviaran el parte m\u00e9dico de IT a la SS de manera inmediata o con un d\u00eda h\u00e1bil de margen como m\u00e1ximo. Acto seguido, la SS comunicara a la empresa la informaci\u00f3n recibida.<\/li>\n<li>Una vez recibida la notificaci\u00f3n, la empresa tendr\u00e1 un plazo m\u00e1ximo de tres d\u00edas h\u00e1biles para formalizar los datos necesarios a trav\u00e9s del sistema RED para gestionar este tr\u00e1mite.
